Seremban MP Withdraws Appeal Over High Court Dismissal Of Defamation Suit
PUTRAJAYA, June 16 (Bernama) -- Seremban Member of Parliament Loke Siew Fook today withdrew his appeal at the Court of Appeal here against a high court's dismissal of his RM5 million defamation suit against two state MCA leaders.
A three-member panel led by Datuk Alizatul Khair Osman Khairuddin struck out the appeal after Loke's lawyer, Gobind Singh Deo informed the court he was withdrawing the appeal with no order as to costs.
Alizatul, who presided together with justices Datuk Mohamad Ariff Md Yusof and Datuk Mah Weng Kwai also did not make any order on costs.
Following this decision, the high court's decision on Nov 29, last year to dismiss Loke's defamation suit against Negeri Sembilan MCA deputy chief Jason Lee Kee Chong and secretary Datuk Lim Fui Ming stands.
Loke, who is also Negeri Sembilan DAP chief, had sued the duo over defamatory remarks which were published in an article in the Guang Ming Chinese daily on Feb 24, 2012.
Loke had said that the article seriously damaged his credibility and reputation.
The high court had ruled that although the contents of the article were defamatory to Loke, he had however, failed to prove the remarks were made by Lee and Lim.
Lee was represented by lawyer, V. Ganesalingam while Haresh Mahadevan appeared for Lim.
